Consent and Release

So, here’s the deal: by checking the little box on the interview sign-up form that reads: “I agree to the terms of Unify America’s Consent and Release” you’re giving permission that allows Unify America to video record you, and use that recording as we see fit for educational, training, marketing or other purposes. If you agree, the legalese below gives us the ability to edit any recordings of you, adding audio-visual elements to it, combining it with other recordings, associating it with your name and other information about you, and it also gives us ownership over the recordings of you. You’ll also certify that you’re at least 18, or have a parent’s permission, and that you accept the risks of being involved in Unify America’s efforts.

Without limiting anything below, we want you to know: our goal is to show how Americans are capable of listening to each other, growing, and thinking logically, rationally and compassionately.

Okay, here’s how the lawyers put it (and what you’re actually agreeing to):

In exchange for the opportunity to participate in Unify America related activities and other good and valuable consideration, I hereby grant to Unify America (and its employees, agents, licensees, successors, vendors and partners, as applicable), the following irrevocable rights and permissions:

  • the right and permission to copyright and/or publish, reproduce or otherwise use my name and other information about me, my voice, my likeness, and the words I’ve spoken (“Materials of Me”), in video, photographs, written materials, audio-visual recordings or other mediums.
  • all ownership rights to the Materials of Me, worldwide, in perpetuity the right and permission to use, copyright, publish, sell, distribute, and/or promote the Materials of Me.
  • the right and permission to edit, copy, exhibit, publish and/or distribute the Materials of Me. I also understand the Materials of Me may be used individually or in conjunction with other media (e.g. video, graphics, text, sound) in any medium, including without limitation to print publications, digital publications, and/or public broadcast for any lawful purpose. I hereby release any and all claims against Unify America or any person or organization utilizing the Materials of Me for any lawful purpose whatsoever.

 

I understand and agree that there is no time limit on the validity of this release and consent nor is there any geographic limitation on where the Materials of Me may be distributed.

I understand my participation is voluntary and that I may discontinue my involvement with Unify America at any time. Once I agree to this release and consent, however, all of its terms apply.

I understand that Unify America can see no risk presently, and I take full responsibility for my involvement in Unify America’s activities and the risks that it may entail (be they legal, physical, psychological or any other) and release Unify America from any and all claims, demands, losses, damages, suits, and liabilities of any kind whatsoever in connection with my involvement in activities related to Unify America.

I hereby certify that I am over eighteen (18) years of age and am competent to contract in my own name insofar as this consent and release is concerned. I acknowledge that I have completely read and fully understand the above consent and release and agree to be bound thereby.

For participants under eighteen years of age:

I am the parent or legal guardian of the intended participant. I have completely read and fully understand this document and, in behalf of the intended participant, consent to all of its terms.
